Terms of use

Welcome to Personal IT Guy. These Terms of Use (the "Terms") govern your use of the Personal IT Guy software (the "Software"), its website (the "Site") and the related services. Please read them carefully - using the Software or the Site constitutes full acceptance of these Terms. If you do not agree with them, do not use the Software and uninstall it.

Scope - both systems:
• The Site: its information pages, the service details and the software download.
• The Software: the application installed on a Windows computer, all of its screens and tools, and its version updates.
These Terms apply to both. A clause that applies to only one of them says so in its heading.

1. Eligibility and acceptance
Use is permitted from age 18, or with a guardian's consent. By installing or using the Software you confirm that you have read, understood and accepted these Terms. If you use the Software on behalf of a business or organisation, you represent that you are authorised to bind it to these Terms.

2. What the Software does - and what it is not
The Software is a tool for diagnosing and testing a personal computer: hardware, operating system, installed software, storage, network, display, audio, input devices and temperatures. It presents information, explains it in plain language and suggests recommendations and remedial steps, alongside an AI-based assistant and guided walkthroughs.
The Software is not antivirus software, does not perform data recovery, and is not a substitute for inspection, diagnosis or individual advice by a qualified technician. Whether to act on any recommendation is your decision and your responsibility.

3. Licence to use
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Software for private or internal-organisational purposes. You may not copy, distribute, sell, rent, sub-license, modify, decompile, reverse-engineer or create derivative works from the Software, except to the extent expressly permitted by law. You may not remove or obscure ownership, copyright or credit notices.

4. Cost, and a possible future paid model
As of the date of these Terms, the Software is available to download and use free of charge. We may in future introduce paid versions, features or plans. Charging will not apply retroactively to a version already installed on your machine, and the payment terms, price and cancellation rights will be presented explicitly and in advance before any transaction. Any paid transaction concluded at a distance is subject to the Israeli Consumer Protection Law, 1981, and its regulations, including as to disclosure, cancellation and refunds.

5. The AI capabilities (applies to the Software)
The AI capabilities require separate approval of the "Use of AI" document, and your own personal API key for the Google Gemini service:
• The key is yours, is stored encrypted on your machine, and any usage cost is between you and Google.
• Queries go directly from your computer to Google. We are not a party to the conversation and do not store its content.
• AI answers are generated automatically and may be wrong or incomplete. Do not rely on them as professional, legal, medical or financial advice.
• Such use is also subject to Google's terms of service and privacy policy.

6. Actions that change your machine, backups and administrator mode (applies to the Software)
Some tools only present information, while others let you act on the system - ending a process, changing a setting, disabling a startup item or running a command. Those actions are performed by you, with your consent, and at your responsibility.
• It is your responsibility to back up anything important before making any change to the system.
• Some screens require administrator permissions. Administrator mode grants the Software broad operating-system permissions, for that session only, in order to read hardware information and perform actions that require it. It is enabled at your choice and with Windows' own approval prompt.

7. Network tools - authorised use only (applies to the Software)
The Software includes tools for network scanning, device discovery, port scanning, service probing and remote connections (SSH/Telnet/ADB). You may use them only on networks and devices you own or have explicit permission to test. Using these tools against someone else's network or device without permission may constitute an offence under the Israeli Computers Law, 1995, and other laws - and full responsibility for that lies with you.

8. Prohibited uses
You may not use the Software or the Site for any unlawful or harmful purpose; infringe third-party rights; attempt to disrupt, circumvent or breach security mechanisms of the Software, the Site or any other system; use the Software to collect information about others without their permission; or use the service in a way that places an unreasonable load on it.

9. Software updates (applies to the Software)
The Software checks our server for a newly published version and lets you install it. An update is performed only after your approval. We may discontinue support for older versions, and may change, add or remove capabilities from time to time.

10. Third-party and open-source software (applies to the Software)
The Software uses third-party components and open-source libraries, each subject to its own licence. The list of components and licences is shown in the "About" screen and in the files shipped with the Software. Nothing in these Terms derogates from the terms of those licences.

11. Human support services
The remote support, business IT and consulting services offered on the Site are not part of the Software. They are provided separately and by prior arrangement, and their terms and prices are set out in a separate agreement or quotation. Remote access to your machine will take place only with your consent, in your presence, and by means agreed in advance.

12. Intellectual property
All rights in the Software, code, design, interface, content, name and marks belong to the service operator or its licensors. They may not be used commercially or otherwise without prior written permission.

13. Limitation of liability
The Software, the Site, the information and the recommendations are provided "AS IS" and as available. We invest effort in accurate and reliable information but make no warranty, and are not liable for any direct, indirect, incidental, special or consequential damage - including data loss, lost profit, downtime or hardware damage - arising from use of the Software, reliance on its information or performing an action it recommended. Our total liability, on any cause of action, shall not exceed the amount you paid us for the Software in the twelve months preceding the event. Nothing here derogates from non-waivable statutory rights, including under the Israeli Consumer Protection Law, 1981.

14. Indemnity
If we suffer damage, loss or expense (including legal fees) as a result of your use of the Software in breach of these Terms or of the law, you will indemnify us for it.

15. Availability and discontinuation
We do not guarantee continuous availability of the Site, the update servers or related services. We may suspend or discontinue the service, in whole or in part, for operational or legal reasons. You may stop using it at any time by uninstalling the Software.

16. Changes to these Terms
We may update these Terms from time to time. The updated version will be published on this page with the update date at the top; a material change will also be brought to your attention inside the Software. Continued use after an update constitutes acceptance of the updated version.

17. Governing law and jurisdiction
These Terms are governed solely by the laws of the State of Israel. Exclusive jurisdiction over any related dispute lies with the competent courts of the Tel Aviv-Yafo District.

18. General
If any provision of these Terms is held unenforceable, the remaining provisions stay in force. Failure to enforce a right is not a waiver of it. These Terms, together with the Privacy Policy and the Use of AI document, constitute the entire agreement between us regarding the Software.

Privacy policy

This Privacy Policy explains what information is collected when you use the Personal IT Guy software (the "Software") and its website (the "Site"), why it is collected, what is done with it and what rights you have over it. It is written in accordance with the Israeli Protection of Privacy Law, 1981, including Amendment 13 to that law, and the regulations enacted under it - chiefly the Protection of Privacy (Data Security) Regulations, 2017.

Scope - both systems:
• The Software: what is collected and stored on your computer, and what it sends to us or to a third-party provider.
• The Site: cookies, details submitted through it, and server logs.
This policy covers both. Where the two differ, it says so explicitly.

The scale of the operation does not require appointing a data protection officer. Every privacy enquiry is handled directly by the service operator, at the email address above.

2. The guiding principle - your diagnostics stay on your machine
Every check the Software runs - CPU, memory, disk, network, temperatures, processes, installed software, display, audio and input devices - runs locally on your computer. Results, reports, chat history and settings are stored on your machine only. We do not scan your computer remotely, we do not upload files from it, and we do not see its contents.

3. What does reach us
3.1 Details you provide voluntarily. In the setup wizard you may provide a full name, email address, phone number, business name and headcount. Every field is optional and can be skipped while still using the Software in full. The email address serves as your user identifier.
3.2 Activity marker. If an email address was provided, it is sent to us each time the Software starts, in order to update your last-used date. We do not record what you did in the Software - only when it was last opened.
3.3 Routine server requests. The Software contacts our server to check whether a new version was published, to fetch system messages and to read operational settings. As with any browsing, these requests expose your IP address and request details, which are written to the server log for operations and security.
3.4 Enquiries to us. If you email us, we keep the enquiry and its contact details in order to handle it and record how it was handled.

4. Purposes of use and the statutory disclosure
In accordance with the disclosure duty in the Protection of Privacy Law we clarify:
• You are under no legal obligation to give us any information. Providing it is voluntary and consent-based, and the Software can be used without it.
• The information is used to identify the user, provide support and answer enquiries, send version updates and system messages, improve the Software and meet legal obligations.
• Without contact details we cannot reach you, provide personal support or notify you about updates.
• The information is stored in the service's database, and access to it is limited to the service operator alone.

5. Artificial intelligence - what is sent, and to whom
The AI capabilities work against the Google Gemini service, and only after you approve the dedicated "Use of AI" document and enter your own personal API key:
• The key is stored encrypted on your computer and is never sent to us.
• Queries go directly from your computer to Google LLC's servers, not through our servers. We do not see, collect or store the content of your conversations.
• Relevant diagnostic data from the machine (such as CPU model, amount of memory or a test result) may be sent alongside your question so the answer is accurate.
• You must use a key with Billing enabled. On the free tier Google may use submitted content to train and improve its models.
• Do not enter sensitive information into the AI fields - ID numbers, payment-card details, medical information or trade secrets.
• Such use is also subject to Google's terms of service and privacy policy.

6. Cookies and local storage on the Site
The Site uses cookies and browser Local Storage:
• Essential cookies - a secure admin session, security tokens (CSRF) and protection against malicious login attempts. These are essential to the Site's operation and cannot be disabled.
• User preferences - language (Hebrew/English), display mode (light/dark), the accessibility settings you chose and the cookie-notice acknowledgement. Stored in your browser only.
We use no advertising cookies, no external analytics and no third-party tracking of any kind. You may block or delete cookies via your browser settings; some Site functionality may be impaired.

7. Disclosure to third parties
We do not sell, rent or trade your personal information. It will be disclosed to a third party only where: you consented; a legal duty or judicial order applies; or it is needed to defend our legal rights in proceedings. Infrastructure providers that host the service act as data holders on our behalf and may not make independent use of the data.

8. Data security
We apply reasonable and accepted security measures suited to the security level that applies to us: an encrypted connection (HTTPS), passwords stored only as one-way hashes, protection against SQL injection, CSRF tokens, login rate limiting, blocked direct access to the database, and permissions kept to the minimum required. That said, no online system can be guaranteed absolutely secure.

9. Retention period
Registration details are kept while you use the service, and thereafter for as long as legal obligations require. Email enquiries are kept for a reasonable period to document how they were handled. Server logs are kept for a short period for operations and security. At the end of the period the data is deleted or de-identified.

10. Your rights
You have the following rights:
• To review the information held about you.
• To request correction of information that is inaccurate, incomplete or out of date.
• To request deletion of the information, subject to the exceptions in law.
• To withdraw a consent you gave and ask to stop receiving communications.
To exercise these rights, email us at ✉info@pitguy.com. We will respond within 5 business days. If you believe your rights were infringed, you may lodge a complaint with the Israeli Privacy Protection Authority.

11. Messages and marketing
System messages are shown inside the Software and concern its operation (for example, a new version). We will not send you advertising material by email or SMS without your prior explicit consent, and every such message will include a simple way to opt out, in accordance with the Israeli Communications (Telecommunications and Broadcasting) Law, 1982.

12. Minors
The service is not intended for minors under 18 without a guardian's consent. We do not knowingly collect information from minors without such consent. If you learn that a minor provided us with information, contact us and it will be deleted.

13. Transfers outside Israel
Our database is hosted in Israel. Google's AI service runs on servers outside Israel, so the AI queries you initiate are transferred abroad - directly from your computer and subject to Google's policies.

14. Security incidents
In the event of a serious security incident involving personal data, we will act in accordance with the reporting duties in law and notify the people concerned where required.

15. Changes to this policy
We may update this policy from time to time. The updated version will be published on this page with the last-updated date at the top. A material change will also be brought to your attention inside the Software. Continued use after an update constitutes acceptance of the updated version.
